TASSAZIONE DEL DOCENTE DI SCUOLA PUBBLICA CHE IMPARTISCE LEZIONI PRIVATE


Con Risposta n. 63 dell'8 maro 2024 l'Agenzia delle Entrate ha esaminato il caso di un cittadino che svolge abitualmente l'attività di insegnante di lingua straniera con apertura di partita Iva, che è titolare di cattedra presso una scuola statale e che, autorizzato dalla propria dirigente scolastica all'esercizio della libera professione, ha intenzione continuare a lavorare in part­-time effettuando lezioni private 5 o 6 volte alla settimana.Intenzionato a chiudere la partita Iva, l'Istante chiede chiarimenti in merito alle disposizioni previste dall'articolo 1, commi da 13 a 16, della legge 30 dicembre 2018, n. 145, in base alle quali è prevista l'applicazione di un'imposta sostitutiva del 15% sui compensi derivanti dallo svolgimento di lezioni private da parte di docenti titolari di cattedra. Chiede inoltre se, per l'esercizio di tale attività, sia dovuta solo la tassazione diretta del 15% sui compensi. Sul punto l'Agenzia entrate chiarisce che lo svolgimento di 5/6 lezioni a settimana configura proprio quel requisito di "abitualità" che prevede l’apertura di una partita Iva. Pertanto, realizzandosi tale requisito, l'Istante dovrà mantenere la partita Iva e valutare se: continuare ad applicare il regime "forfetario", con tassazione del reddito, ai fini Irpef, con l'aliquota del 15%, senza applicazione dell'Iva, ma con obbligo di fatturazione; applicare il regime "speciale" previsto dalla Legge di Bilancio 2019, con applicazione dell'imposta sostitutiva Irpef del 15% sui compensi derivanti dall'attività di lezioni private e ripetizioni, con obbligo di fatturazione, in regime di esenzione Iva.
