Le startup innovative a vocazione sociale


Il Decreto-Legge 179/2012, convertito con Legge 221/2012, che ha introdotto la nozione di nuova impresa innovativa ad alto valore tecnologico (cd startup innovativa) ha individuato anche la fattispecie particolare delle startup innovative “a vocazione sociale” (“SIAVS”). Secondo l’art. 25, comma 4, le SIAVS possiedono gli stessi requisiti posti in capo alle altre startup innovative, ma operano in alcuni settori specifici che l’articolo 2, comma 1, del D. Lgs 155/2006 sull’impresa sociale, considera di particolare valore sociale. I settori individuati da tale provvedimento sono: assistenza sociale; assistenza sanitaria; educazione, istruzione e formazione; tutela dell’ambiente e dell’ecosistema; valorizzazione del patrimonio culturale; turismo sociale; formazione universitaria e post-universitaria; ricerca ed erogazione di servizi culturali; formazione extra-scolastica, finalizzata alla prevenzione della dispersione scolastica e al successo scolastico e formativo; servizi strumentali alle imprese sociali, resi da enti composti in misura superiore al settanta per cento da organizzazioni che esercitano un’impresa sociale. Poiché le finalità “sociali” delle SIAVS possono renderle meno “competitive” e “performanti” sul mercato, l’art. 29 del D.L. 179/2012 riconosceva inizialmente benefici fiscali maggiorati a favore di coloro che investono in questa particolare tipologia di startup innovativa. Il vantaggio fiscale è venuto meno con il successivo aumento delle detrazioni destinate a tutte le startup innovative, ma le SIAVS restano avvantaggiate nell’ottenimento di finanza agevolata. Il riconoscimento della finalità sociale in capo alla SIAVS non è limitato alla corrispondenza con i relativi codici Ateco ma è prevista un’autocertificazione con cui l’impresa: dichiara di operare in via esclusiva in uno o più dei settori elencati all’articolo 2, comma 1, del decreto legislativo 24 marzo 2006, n. 155; specifica il/i settore/i; dichiara di perseguire una finalità d’interesse sociale; si impegna a dare evidenza dell’impatto sociale così prodotto. Per quest’ultimo requisito è necessario che sia redatto, una volta l’anno, un “Documento di descrizione di impatto sociale”, secondo le linee guida fornite dalla normativa.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
