ISA E CONCORDATO PREVENTIVO: MODALITà E SPECIFICHE PER L'ACQUISIZIONE DEGLI ULTERIORI DATI


Con Provvedimento del 12 aprile sono definite le modalità con cui l’Agenzia delle entrate rende disponibili ai contribuenti, ovvero ai soggetti incaricati della trasmissione telematica, gli ulteriori dati necessari ai fini dell’applicazione degli indici sintetici di affidabilità fiscale (ISA) per il periodo di imposta 2023 e ai fini della elaborazione della proposta di concordato preventivo biennale per i periodi d’imposta 2024 e 2025.Al fine di determinare il punteggio di affidabilità relativo agli ISA ed elaborare la proposta di concordato preventivo biennale riguardante il 2024 e 2025, infatti, per i contribuenti tenuti all’applicazione degli indici sono necessari ulteriori dati, individuati nella Note tecniche e metodologiche allegate ai relativi decreto di approvazione, che l’Agenzia delle Entrate deve rendere disponibili ai medesimi contribuenti. Con lo stesso provvedimento del 12 aprile sono approvate anche le relative specifiche tecniche con cui predisporre i file contenenti l’elenco dei contribuenti per cui gli incaricati della trasmissione telematica richiedono le ulteriori informazioni. Vengono inoltre definite: la modalità di accesso l’accesso puntuale ai dati da parte dei contribuenti e degli intermediari delegati; le specifiche tecniche con cui sono resi disponibili i file contenenti gli ulteriori elementi necessari alla determinazione del punteggio di affidabilità relativo agli ISA applicabili per il periodo d’imposta 2023 e all’elaborazione della proposta di concordato preventivo biennale per i periodi d’imposta 2024 e 2025. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
