FATTURA ELETTRONICA NON ANCORA OBBLIGATORIA PER I FORFETTARI


Nel dicembre 2021 il Consiglio Ue, nel consentire di imporre ai soggetti passivi stabiliti nel territorio dello Stato l'obbligo di fattura elettronica anche per il triennio 2022-2024, ha autorizzato il nostro Paese a estendere tale obbligo anche agli operatori che si avvalgono della franchigia per le piccole imprese di cui all'art. 282 della direttiva 2006/112/Ce e quindi anche ai contribuenti forfettari. Ad oggi però, né il decreto fiscale, né la legge di bilancio 2022 e neppure il decreto "Milleproroghe" hanno modificato le regole esistenti. Pertanto non sono tenuti all'emissione di e-fattura mediante SdI i "soggetti passivi che rientrano nel cosiddetto «regime di vantaggio» (...) e quelli che applicano il regime forfettario (...)". Si ricorda tuttavia che l'utilizzo della fatturazione elettronica per questi soggetti può avvenire su base volontaria e che potrebbe comporterebbe, tra gli altri, il vantaggio che, qualora si garantisca la tracciabilità di tutti i pagamenti ricevuti ed effettuati per operazioni di ammontare superiore a 500 euro, si possa beneficiare della riduzione di due anni dei termini di accertamento ai fini dell'IVA e delle imposte sui redditi.

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
