IMU 2021: I CHIARIMENTI DEL MEF SUL VERSAMENTO DELLA PRIMA RATA


Sul sito internet del MEF (Dipartimento delle Finanze) sono stati pubblicati alcuni chiarimenti in merito agli adempimenti dichiarativi IMU in caso di esenzioni previste in relazione all'emergenza epidemiologica da Covid-19 e al calcolo dell'imposta dovuta per la prima rata. In una du queste viene chiesta conferma del fatto che il calcolo dell'Imposta Municipale Propria (IMU) per l'anno 2021, separatamente per acconto e saldo, si debba effettuare in base alle effettive condizioni soggettive e oggettive dell'immobile intervenute nel corso del primo e del secondo semestre e non come 50% dell'imposta annua. Il MEF conferma la soluzione prospettata nel quesito relativamente al versamento della prima rata, sulla base del combinato disposto dei commi 761 e 762 dell'art. 1 della legge n. 160 del 2019, in base ai quali: l'"imposta è dovuta per anni solari proporzionalmente alla quota e ai mesi dell'anno nei quali si è protratto il possesso"; il "versamento della prima rata è pari all'imposta dovuta per il primo semestre applicando l'aliquota e la detrazione dei dodici mesi dell'anno precedente". Pertanto, per un immobile acquistato il 1° giugno 2021 la prima rata dell'IMU, da versare entro il prossimo 16 giugno, deve essere proporzionata a 1 mese di possesso e non deve essere parametrata al 50% del calcolo dell'imposta effettuato su 7 mesi. Del resto, tale aspetto è stato affrontato anche nella circolare n. 1/DF del 2020 laddove, per l'acconto relativo al 2020, è stato chiarito che "... sembra percorribile anche la possibilità per il contribuente di versare l'acconto sulla base dei mesi di possesso realizzatisi nel primo semestre del 2020, tenendo conto dell'aliquota dell'IMU stabilita per l'anno precedente come previsto a regime dal comma 762...."
