IL SISTEMA PUBBLICO DI IDENTITà DIGITALE: NUOVO STUDIO DEL NOTARIATO


Sul sito internet del Notariato è stato pubblicato lo studio "Il sistema pubblico di identità digitale", che analizza le caratteristiche, il funzionamento e le prospettive del Sistema Pubblico di Identità Digitale (SPID) quale sistema di autenticazione che il Legislatore ha previsto per consentire ad imprese e cittadini di interagire con la Pubblica Amministrazione e con i privati ed ottenere dagli stessi determinati servizi, attraverso l'utilizzo di sistemi informatici quali PC o dispositivi mobili. Lo Studio, in particolare, ripercorre tutta la storia di SPID, a partire dalla sua nascita nel 2013, fino agli ultimi provvedimenti, compreso il c.d. "D.L. Semplificazioni". Viene analizzato sia sotto il profilo della normativa nazionale che di quella comunitaria, con particolare attenzione al Regolamento eIDAS ed alle varie Direttive e regolamenti attuativi in tema di identità digitale e procedure comuni di identificazione elettronica e di accesso ai servizi. Inoltre, SPID viene valutato quale mezzo di comunicazione con la pubblica amministrazione idoneo a formare il c.d. "domicilio digitale", ed infine fatto oggetto di confronto con gli altri strumenti digitali già presenti nel nostro ordinamento quali la Carta Nazionale dei Servizi (CNS), la Carta di Identità Elettronica e la firma elettronica qualificata, al fine di stabilire l'esatto perimetro di questi strumenti e valutarne affinità e differenze. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
