RIMBORSI PER PERMESSI ELETTIVI FUORI DAL CAMPO IVA: I CHIARIMENTI DELL?"AGENZIA ENTRATE


Con la Risposta ad interpello n. 261 del 9 ottobre 2025, l?"Agenzia delle Entrate ha fornito chiarimenti in merito al trattamento ai fini IVA dei rimborsi per permessi retribuiti fruiti dai lavoratori dipendenti da soggetti privati o da enti pubblici economici per l?"espletamento di mandati amministrativi.In particolare, è stato chiesto se tali permessi possano o debbano essere considerati prestiti o distacchi di personale e, inoltre, se in caso di equiparazione il mandato elettivo avviato il 10 giugno 2024 rientri o meno nell?"ambito di applicazione della nuova disciplina di cui all?"articolo 16-ter del DL n. 131/2024.In merito al primo quesito, l?"Agenzia ha chiarito che i rimborsi erogati dagli enti pubblici ai datori di lavoro per le retribuzioni corrisposte ai dipendenti impegnati in mandati amministrativi o elettivi non costituiscono prestazioni di servizi ai fini IVA.Tali somme, infatti, non possono essere considerate corrispettivi per un distacco o prestito di personale, poiché manca il nesso di reciprocità tra le parti, ossia la cosiddetta “funzione sinallagmatica” tipica dei rapporti a titolo oneroso.Il rimborso non ha la funzione di compensare un servizio reso dal datore di lavoro all?"ente, ma quella di consentire al lavoratore eletto di esercitare liberamente il proprio mandato pubblico, senza che ciò comporti un onere economico per il datore di lavoro.Pertanto, tali rimborsi restano esclusi dal campo di applicazione dell?"IVA, non potendosi configurare come operazioni imponibili ai sensi dell?"articolo 3 del DPR n. 633/1972.Con riferimento al secondo quesito, l?"Agenzia ha precisato che, poiché la fattispecie in esame non rientra nell?"ambito dei prestiti o distacchi di personale disciplinati dall?"articolo 30 del D.Lgs. n. 276/2003, non trova applicazione l?"articolo 16-ter del DL n. 131/2024, la cui operatività è limitata ai contratti di distacco o prestito di personale stipulati o rinnovati a decorrere dal 1° gennaio 2025.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
