Esecuzioni Immobiliari: 10 passi per il pagamento telematico dei diritti per la pubblicazione di un avviso di vendita sul Portale delle Vendite Pubbliche


Per effettuare la pubblicazione di un avviso di vendita sul Portale delle Vendite Pubbliche occorre compiere due passaggi obbligati e per entrambi è necessario essere muniti di smart card (o chiavetta per firma digitale). Pagamento dei diritti (euro 100 + commissioni) mediante accesso al sito https://pst.giustizia.it Inserimento dei dati e dei documenti necessari per la pubblicazione, compresa la RT (Ricevuta Telematica relativa al pagamento dei diritti) mediante accesso all'area riservata del Portale delle vendite pubbliche (indirizzo https://pvp.giustizia.it) Riteniamo necessario che, al momento del conferimento della delega nell'udienza ex art. 569 c.p.c., il Giudice dell'Esecuzione ordini l'apertura di un conto corrente intestato alla procedura stessa ove il creditore procedente depositi l'importo necessario alle formalità pubblicitarie. Il Giudice, a nostro avviso, dovrebbe informare sin da subito il creditore che, in mancanza di versamento del fondo spese, non saranno eseguite le formalità pubblicitarie con tutte le conseguenze del caso. Il Delegato, una volta appurato il versamento, verificherà che non ci siano problemi di sorta che rendano impossibile la pubblicazione e procederà pertanto alla richiesta di pubblicare sul portale delle vendite pubbliche (e con le altre modalità disposte dal Giudice). Si ricorda che il versamento dei diritti non è generico, ma riferito alla singola procedura esecutiva, e la richiesta di rimborso (unica procedura di rimedio in caso di errore) non verrà probabilmente esaudita in tempi brevi. Abbiamo inserito la pubblicazione di una procedura esecutiva sul Portale delle Vendite Pubbliche e la illustriamo per immagini passo a passo. Noi utilizziamo una chiavetta per la firma digitale, ma la procedura è simile per la smart card. E' opportuno chiudere tutti gli altri browser, che interferiscono con il browser utilizzato dalla chiavetta, inserire la chiavetta, inserire la password ed aprire il browser con il programma all'interno della chiavetta.
