COMMERCIALISTI: NEL DDL LAVORO CRITICITà EVIDENTI SULLE DIMISSIONI VOLONTARIE


Nel documento presentato nel corso dell’audizione parlamentare sul Ddl C. 1532-bis recante disposizioni in materia di lavoro, il Consiglio Nazionale dei Commercialisti, pur apprezzando l'introduzione di contromisure correttive finalizzate a rendere nuovamente ammissibili le dimissioni per “fatti concludenti” per contrastare la cattiva pratica dell’assenteismo programmato per ottenere il licenziamento dal proprio datore di lavoro e, conseguentemente, il trattamento NASPI, sottolinea quanto la formulazione dell'art. 9 del Ddl mostri "criticità evidenti circa la scelta degli elementi integranti la nuova fattispecie di dimissioni volontarie". Secondo i Commercialisti la sola assenza ingiustificata protratta per oltre cinque giorni o oltre il termine previsto dal contratto collettivo non rappresenta un elemento sufficiente a configurare la risoluzione del rapporto di lavoro con imputazione al lavoratore dimissionario. "Il comportamento/inadempimento qualificante la fattispecie delle dimissioni" spiegano ancora i Commercialisti, "dovrebbe configurarsi in modo decisamente più rigoroso, anche al fine di evitare la proliferazione di un pericoloso contenzioso per gli stessi datori di lavoro. Lo schema giuridico dovrebbe ricalcare quello già teorizzato in passato dalla dottrina e accolto dalla giurisprudenza delle dimissioni per fatti concludenti". Sempre in materia di dimissioni volontarie i commercialisti chiedono l’abilitazione alla procedura telematica per la presentazione delle dimissioni lavoratore subordinato, per rimediare alla grave disparità di trattamento tra categorie professionali.In materia, invece, di somministrazione di lavoro, hanno chiesto l’eliminazione dell’emendamento che stabilisce che un’impresa utilizzatrice possa ricorrere senza limiti alla somministrazione di lavoratori, sia a tempo determinato sia a tempo indeterminato, per il solo fatto che il lavoratore somministrato sia assunto dal somministratore con contratto a tempo indeterminato.
