Ancora disservizi per lo spesometro: i commercialisti pronti alla protesta


Con un comunicato stampa congiunto, le associazioni dei Commercialisti (ADC - AIDC - ANC - ANDOC - UNAGRACO - UNGDCEC - UNICO) preannunciano incisive forme di protesta in mancanza di una nuova e più ampia proroga rispetto a quella annunciata del prossimo 5 ottobre. Ecco il testo del comunicato: Tramite inaccettabile comunicato stampa dell'Agenzia delle Entrate, è stata resa nota la proroga del termine dell'invio dei dati delle fatture al 5 ottobre. E' infatti impensabile che il caos del nuovo spesometro si risolva semplicemente concedendo 7 giorni (5 giorni lavorativi) in più per l'adempimento, così come non è credibile da parte dell'Amministrazione Finanziaria il tentativo di minimizzare la portata dei problemi che hanno determinato la sospensione del servizio della piattaforma web "Fatture e Corrispettivi". Era giusto pretendere dall'Agenzia delle Entrate un comunicato che desse spiegazione dei fatti accaduti e indicazioni chiare sulla tempistica per il pieno ripristino del servizio, non ancora completamente avvenuto, ed era giusto aspettarsi delle doverose scuse. La risposta invece è stata non solo tardiva ma anche del tutto inadeguata. L'aspetto più grave è che la vulnerabilità del sistema sul fronte della privacy non è stata risolta.  Se per l'anomalia riguardante la ricerca per ID delle ricevute di trasmissione, la situazione è rimasta immutata, per quanto riguarda il problema del codice fiscale, è stato inserito un alert che informa l'utente sul rispetto della normativa sulla privacy e sulle responsabilità connesse agli eventuali abusi che possono essere rilevati. Dal messaggio di avviso è legittimo supporre che la possibilità di accessi indebiti non sia stata tecnicamente bloccata, eppure il servizio è stato nuovamente reso disponibile online. Non è ricevibile, inoltre, il riferimento alla discrezionalità nell'applicazione delle sanzioni, una mostruosità questa sul piano del diritto amministrativo in quanto non è prerogativa dell'Agenzia pronunciarsi sull'applicabilità delle norme, e costituisce un'offesa ai cittadini, lesi nei loro diritti. Le Associazioni dei commercialisti sono rimaste, ad oggi, inascoltate e forse, alla luce del comunicato diffuso dall'Agenzia, un loro preventivo coinvolgimento sarebbe stato non solo auspicabile ma opportuno. Le scriventi Associazioni hanno creduto molto nell'attività di dialogo con le Istituzioni, ma se continuano a proliferare gli adempimenti, ad esserci proroghe dovute ai disservizi della Pubblica Amministrazione, se professionisti e cittadini corrono il rischio di sanzioni che non trovano giustificazione, e se la semplificazione che si vuole proporre è fatta solo di slogan, probabilmente la strada da percorrere è un'altra. In mancanza di una presa di posizione forte da parte del MEF, di un tempestivo intervento chiarificatore da parte dell'Amministrazione Finanziaria e del relativo partner tecnico Sogei, che possa prevedere anche un incontro con le Associazioni dei commercialisti, e se non sarà disposta una proroga più ampia rispetto al termine del 5 ottobre, se non addirittura l'eliminazione dell'adempimento che la Pubblica Amministrazione ha dimostrato di non saper gestire, con evidenti danni subiti da intermediari e contribuenti, le Associazioni sono decise ad intraprendere nuove ed incisive forme di protesta nei confronti di una situazione non più vivibile e che le stesse hanno già più volte denunciato.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
