L'OCF CHIEDE UNA MORATORIA PER LA FORMAZIONE DEGLI ELENCHI DEI DELEGATI ALLE VENDITE GIUDIZIARIE


Con Comunicato Stampa del 9 marzo 2023 l'Organismo Congressuale Forense "chiede con fermezza una moratoria per la formazione degli elenchi, fintantoché le nuove disposizioni non consentiranno ai delegati di essere nelle condizioni di scegliere in base a quale requisito essere iscritti nei detti elenchi". Come noto, la Riforma Cartabia ha introdotto nuovi criteri di nomina e di permanenza negli elenchi dei delegati alle vendite giudiziarie formati dai vari Tribunali.La norma sarebbe dovuta entrare in vigore il 30 giugno 2023 ma, in sede di conversione della Legge di bilancio, il termine è stato anticipato al 28 febbraio 2023, con termine per presentare domanda di iscrizione negli elenchi al prossimo 31 marzo.Questa situazione "paradossale", spiega l'OCF, porterà la gran parte degli attuali delegati alle vendite a vedersi sostanzialmente preclusa l’attività: i nuovi criteri per la nomina, infatti, sono tre e devono essere posseduti alternativamente tra loro.  Potranno quindi presentare domanda per essere inseriti nei nuovi elenchi soltanto i professionisti che avranno ottenuto almeno dieci deleghe alle vendite giudiziarie nel quinquennio precedente (quindi, dato che le domande dovranno essere presentate entro il 31 marzo 2023, si parla di dieci incarichi conseguiti tra il 31 marzo 2018 ed il 31 marzo 2023). Questo, spiega l'OCF, comporta ovvie ricadute negative sui giovani professionisti che, come anticipato, si vedrebbero precluso l’accesso agli elenchi. "Fino a che non si consentirà di poter soddisfare alternativamente ognuno dei tre requisiti per l’iscrizione negli elenchi", dichiara ancora l'OCF, "appare illogico e oltremodo limitativo cancellare de plano i vecchi elenchi a vantaggio di pochissimi “favoriti”; sarebbe certamente più equo consentire la nuova iscrizione secondo la normativa previgente e sostituire gli elenchi ad oggi in uso ai vari Tribunali soltanto quando si potrà ragionevolmente dimostrare di soddisfare uno dei tre requisiti alternativi".
