ANCHE IL LAVORATORE PUò CHIEDERE AL FISCO LA RESTITUZIONE DELLE SOMME NON DOVUTE


La Corte di Cassazione, Sezione V Civile, con l'Ordinanza n. 11050 del 27 aprile 2021 si è espressa in tema di rimborso delle imposte sui redditi, ai sensi dell'art. 38 del d.P.R. n. 602 del 1973 e, confermando precedenti orientamenti, ha affermato che sono legittimati a richiedere all'Amministrazione finanziaria il rimborso della somma non dovuta e ad impugnare l'eventuale rifiuto dinanzi al giudice tributario sia il soggetto che ha effettuato il versamento (cd. "sostituto d'imposta"), sia il percipiente delle somme assoggettate a ritenuta (cd. "sostituito"). Di conseguenza il lavoratore, che si identifica con il contribuente, vanta e può esercitare il diritto al rimborso delle somme indebitamente ritenute alla fonte e versate dal datore di lavoro, restando del tutto indifferente ai fini della spettanza del beneficio la circostanza che la somma, oggetto ai richiesta di rimborso, sia stata versata tramite ritenute operate dal sostituto d'imposta.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
