RITENUTA AL 25% SU OPERAZIONI A PREMIO PER TITOLARI DI PARTITA IVA


Ai premi ricevuti da soggetti titolari di partita IVA (PMI o liberi professionisti) per effetto della sottoscrizione di un contratto di fornitura di energia elettrica e di gas naturale, che rientrano quindi nelle categorie reddituali del reddito d'impresa ovvero del reddito di lavoro autonomo, si applica la ritenuta alla fonte con l'aliquota del 25%, con facoltà di rivalsa da parte della società che promuove l'operazione a premi. Avendo facoltà di rivalsa, il sostituto d'imposta può decidere se addebitare la ritenuta oppure sopportarne il costo. In questo caso, trova applicazione quanto stabilito all'articolo 99, comma 1, del Tuir, secondo cui «le imposte sui redditi e quelle per le quali è prevista la rivalsa, anche facoltativa, non sono ammesse in deduzione». Nel caso di specie la ritenuta, non essendo deducibile in capo al percettore del premio, non può esserlo neanche per il soggetto che opera la ritenuta in conseguenza del fatto che lo stesso ha rinunciato alla rivalsa.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
