Legge di bilancio: dal 1 gennaio 2022 obbligo anche per i piccoli datori di lavoro della copertura delle integrazioni salariali


La nuova riforma degli ammortizzatori sociali avvenuta con legge n. 234/2021 ha introdotto l'obbligo per tutte le aziende che occupano almeno 1 dipendente, a partire dal 1° gennaio 2022, di essere iscritte ad un Fondo di solidarietà Bilaterale, che deve essere istituito dalle rappresentanze sindacali datoriali e dei lavoratori del proprio settore, o in alternativa al FIS (Fondo di integrazione salariale). Le prestazioni Il Fondo eroga l'assegno di integrazione salariale, che ha la durata di: 13 settimane in un biennio mobile, in favore dei dipendenti da datori di lavoro che, mediamente, occupano fino a 5 dipendenti; 26 settimane in un biennio mobile, in favore dei dipendenti da imprese che, mediamente, occupano più di 6 dipendenti. L'ammontare dell'assegno di integrazione salariale ha un massimale di importo pari a quello delle altre integrazioni ordinarie, straordinarie e di solidarietà. L'aliquota di Finanziamento del FIS (i Fondi bilaterali declineranno la propria aliquota specifica) L'aliquota di finanziamento ordinaria del FIS è: 0,50% per i datori di lavoro che, mediamente, occupano fino a 5 dipendenti; 0,80% per i datori di lavoro che, mediamente, occupano oltre 5 dipendenti È stata introdotta la possibilità (a partire dal 1° gennaio 2025) per le aziende fino a 5 dipendenti di un abbassamento dell'aliquota nella misura del 40% se per 24 mesi non ricorreranno ad alcun ammortizzatore. Per il solo anno 2022 le aliquote del FIS sono: 0,15% per i datori dimensionati fino a 5 dipendenti 0,55% se i lavoratori sono compresi tra i 6 ed i 15 0,69% se l'organico è superiore alle 15 unità. Le imprese esercenti le attività commerciali, logistica, viaggio e turismo, operatori turistici che occupano più di 50 dipendenti pagano lo 0,24%; Il contributo addizionale dovuto per le integrazioni salariali del FIS è pari al 4% della retribuzione persa. ATTENZIONE: a partire dal 1° gennaio 2022, la regolarità del versamento dell'aliquota ordinaria ai predetti Fondi è condizione per il rilascio del DURC. A chi spettano le prestazioni A tutti i lavoratori subordinati, compresi i lavoratori a domicilio e gli apprendisti di primo e terzo livello, con esclusione del personale con qualifica dirigenziale. Per accedere alle integrazioni salariali, i dipendenti dovranno avere 30 giorni di lavoro effettivo nell'unità produttiva, ad eccezione dei trattamenti ordinari di integrazione salariale per eventi non oggettivamente evitabili. Nel computo vanno comprese le ferie, le malattie, gli infortuni sul lavoro e l'assenza obbligatoria per maternità. Il lavoratore che svolgerà attività di lavoro subordinata di durata superiore a 6 mesi o anche di lavoro autonomo durante il periodo integrativo non avrà diritto al trattamento per le giornate di lavoro prestate. Se l'attività sarà a tempo determinato con un contratto inferiore ai 6 mesi il trattamento verrà sospeso per la durata del rapporto di lavoro.
