ALLE SEZIONI UNITE LA TUTELA DEL CONTRIBUENTE NEL CASO DI ACCESSI E VERIFICHE PRESSO LA SEDE O L'ABITAZIONE


L’ordinanza interlocutoria n. 10664 del 22.04.2021 della Sez. V della Cassazione ha rimesso al Primo Presidente al fine della eventuale assegnazione alle Sezioni Unite per la necessaria definizione delle seguenti questioni di diritto per le quali le sezioni semplici si sono pronunciate in senso difforme o che appaiono di massima di particolare importanza: se la mancanza della necessaria autorizzazione del procuratore della Repubblica o dell'autorità giudiziaria all'apertura di una valigetta in sede di accesso e, d'altro lato, dal mancato assolvimento dell'obbligo di informazione della facoltà di farsi assistere da un professionista, se, in caso di apertura della valigetta reperita in sede di accesso, la mancanza di autorizzazione di cui all'art. 52, comma 3, d.P.R. n. 633/1972, possa essere superata dal consenso prestato dal titolare del diritto; se, nel caso in cui si dia risposta positiva alla prima questione, il consenso può dirsi libero ed informato anche qualora l'amministrazione finanziaria non abbia informato il titolare del diritto della facoltà, di cui all'art. 12, comma 2, legge n. 212/2000, di farsi assistere da un professionista abilitato alla difesa dinanzi agli organi della giustizia tributaria; se, infine, l'eventuale inosservanza del suddetto obbligo di informazione ed il conseguente vizio del consenso del titolare del diritto comporti l'inutilizzabilità della documentazione acquisita in mancanza della prescritta autorizzazione. La questione circa l’utilizzabilità in sede tributaria delle informazioni acquisite senza le necessarie tutele processuali di cui al codice di procedura penale (artt. 63, 64, 65 c.p.p.) è sempre stata risolta a favore dell’Agenzia delle Entrate, ma forse è venuto il momento di un ripensamento.   Per il testo integrale clicca qui.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
