SENZA CERTEZZA LA DETRAZIONE DEI COSTI PLURIENNALI


Con la sentenza n. 8500 del 25.03.2021 le Sezioni Unite, pronunciando su questione di massima di particolare importanza, hanno affermato il seguente principio: "nel caso di contestazione di un componente di reddito ad efficacia pluriennale per ragioni diverse dall'errato computo del singolo rateo dedotto e concernenti invece il fatto generatore ed il presupposto costitutivo di esso, la decadenza dell'amministrazione finanziaria dalla potestà di accertamento va riguardata, ex art. 43 del d.P.R. n. 600 del 1973, in applicazione del termine per la rettifica della dichiarazione nella quale il singolo rateo di suddivisione del componente pluriennale è indicato, non già in applicazione del termine per la rettifica della dichiarazione concernente il periodo di imposta nel quale quel componente sia maturato o iscritto per la prima volta in bilancio". Ciò comporta un allungamento dei termini di decadenza per la notifica degli avvisi di accertamento, che decorreranno dal singolo anno di imposta in cui è riportato il rateo di costo e ad esempio nel caso di ammortamenti pluriennali, ciò significa moltissimi anni di distanza dall'iscrizione del primo rateo, con le conseguenti difficoltà difensive e la protrazione dell'incertezza.   Per il testo integrale clicca qui.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
