Legittima l'impugnazione dell'avviso bonario - Cass. ordinanza 3466


La Corte di Cassazione – sezione tributaria civile – con ordinanza 3466.21 del 18 novembre 2020 depositata in cancelleria il 11 febbraio 2021 ha stabilito che è legittima l’impugnazione dell’avviso bonario. In sintesi: la comunicazione di irregolarità era relativa ad una sanzione del 30% per tardivo versamento dell’IRAP, versamento  invece eseguito dalla srl con il “ravvedimento operoso” la srl presentava ricorso alla C.T.P. di Roma che dichiarava il ricorso inammissibile, la srl appellava alla C.T.R. del Lazio che confermava per l’inammissibilità del ricorso non rientrando la comunicazione di irregolarità tra gli atti autonomamente impugnabili indicati nell’art. 19 del d.lgs. 546 del 31 dicembre 1992 nei due gradi di giudizio il giudice tributario ha ritenuto che la comunicazione di irregolarità rappresenterebbe un invito trasmesso al contribuente per chiarire la sua posizione fiscale, cosicché la comunicazione non comporterebbe una pretesa certa e definitiva e, quindi, non sarebbe impugnabile. la Corte ritiene invece che l’elencazione degli atti contenuta nell’articolo 19 del d.lgs. 546/1992 pur dovendosi considerare tassativa vada comunque interpretata in senso estensivo, con facoltà e non obbligo per il contribuente di ricorrere al giudice tributario avverso tutti gli atti adottati dall’ente impositore, atti che portino a conoscenza del contribuente una ben individuata pretesa tributaria con l’esplicitazione delle concrete ragioni che la sorreggono. nel caso di specie la comunicazione di irregolarità con l’applicazione di sanzione per ritardato versamento di un’imposta costituisce una pretesa impositiva compiuta che legittima il contribuente alla sua impugnazione, precedendo temporalmente la notifica della cartella di pagamento, atto questo ricompreso nell’elencazione del richiamato art. 19 del d.lgs. 546/1992.
