FATTURAZIONE ELETTRONICA E SISTEMA TESSERA SANITARIA


L'articolo 15 della Legge. n. 157/2019, di conversione del D.L. n. 124/2019, interviene sugli obblighi in materia di fatturazione elettronica riferita ai soggetti tenuti all'invio dei dati al Sistema tessera sanitaria ai fini dell'elaborazione della dichiarazione dei redditi precompilata. Si tratta delle aziende sanitarie locali, le aziende ospedaliere, gli istituti di ricovero e cura a carattere scientifico (IRCCS), i policlinici universitari, le farmacie pubbliche e private, i presidi di specialistica ambulatoriale, le strutture per l'erogazione delle prestazioni di assistenza protesica e di assistenza integrativa, gli altri presidi e strutture accreditati per l'erogazione dei servizi sanitari, nonché gli iscritti all'Albo dei medici chirurghi e degli odontoiatri. In particolare: viene prorogato dal 2019 al 2020 l'esonero dall'obbligo di fatturazione elettronica (comma 1); a decorrere dal 1° luglio 2020 i soggetti tenuti all'invio dei dati al Sistema tessera sanitaria sono obbligati alla memorizzazione e trasmissione dei corrispettivi mediante strumenti tecnologici che garantiscono l'inalterabilità e la sicurezza dei dati, compresi quelli che consentono i pagamenti con carta di debito e di credito (comma 2). The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
