POS obbligatorio ma ancora senza sanzioni


Già l'art. 15 del DL 179/2012 (L. 221/2012) aveva stabilito stabilito che, fin dal 30 giugno 2014, i soggetti che effettuano l'attività di prodotti e di prestazioni di servizi, anche di natura professionale, fossero tenuti ad accettare anche i pagamenti effettuati attraverso carte di debito e carte di credito, salvi i casi di oggettiva impossibilità tecnica. Era stato inizialmente previsto un limite per singola operazione di 30 euro al di sotto del quale si sarebbe potuto rifiutare il pagamento elettronico. Con la legge di Stabilità per 2016 (L. 208/2015) il limite venne ridotto a 5 euro. Nessuna sanzione è però mai stata introdotta per chi non si fosse adeguato alla legge fino al recente decreto fiscale, collegato alla legge di bilancio del 2020 (DL 124/2019) che aveva previsto, a decorrere dal 1° luglio 2020, una sanzione pari a 30 euro, aumentata del 4% del valore della transazione per la quale sia stata rifiutata l'accettazione del pagamento con carte. Nel corso dell'iter di conversione del decreto l'art. 23 che prevedeva le sanzioni in caso di mancata accettazione di pagamento tramite POS è però stato soppresso. Ci ritroviamo quindi, ancora una volta in una situazione paradossale: commercianti, artigiani e professionisti sono obbligati a dotarsi di Pos e, pertanto, non possono negare ai propri clienti la possibilità di pagare tramite carta o bancomat non è però prevista alcuna sanzione per chi non accetta pagamenti tramite Pos.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
