Licenza per prodotti alcoolici: l'agenzia delle dogane interviene


Sulla questione dell'abrogazione e del successivo ripristino delle norme in materia di obbligo di denuncia fiscale per la detenzione di prodotti alcoolici ero intervenuto su questo sito con un breve articolo dello scorso 2 agosto (link). Sull'argomento il 20 settembre l'Agenzia delle Dogane ha emanato la direttiva protocollo 131411/RU, fornendo chiarimenti in relazione al reintrodotto obbligo di richiedere la licenza in questione, licenza prevista dal comma 1 dell'articolo 29 del D.lgs. 504/1995 e per esaminare le diverse fattispecie che l'abrogazione dell'obbligo ed il successivo ripristino si sono venute a creare, in ragione ad esempio della data di inizio dell'attività nel periodo di abrogazione (cioè dal 29 agosto 2017 al 29 giugno 2019), pervenendo alla conclusione che chi ha iniziato l'attività nel periodo di abrogazione di cui sopra presenterà la denuncia di attivazione dell'esercizio di vendita entro il 31 dicembre 2019. Gli operatori che erano già in possesso di licenza non debbono porre in essere alcun adempimento, essendo ritenuta valida a tutti gli effetti la precedente licenza a suo tempo rilasciata, a meno che non siano intervenute variazioni nella titolarità della licenza nel periodo di abrogazione, variazioni che non sono state quindi comunicate. Viene rammentato che per la vendita di prodotti alcoolici in manifestazioni quali sagre, fiere, mostre ed eventi a carattere temporaneo e di breve durata, considerato il periodo limitato di svolgimento, non vige l'obbligo di dotarsi di licenza fiscale e che l'obbligo vige in presenza di un esercizio di vendita in sede fissa o di esercizio di attività in forma permanente o stagionale. In coda al documento dell'Agenzia delle Dogane viene riportato il modulo per la richiesta di rilascio della licenza.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
