FERIE: si possono ancora fare? Violazioni al codice della strada e fatturazione elettronica


Con un articoletto consultabile attraverso il seguente link segnalavamo che nel mese di agosto occorre tenere d'occhio la casella PEC, in quanto le violazioni al codice della strada possono essere definite con pagamento ridotto entro 5 giorni dalla data della notifica e non esiste alcuna norma di sospensione. Mancando il buon senso da parte del legislatore che ha altro di cui occuparsi, resta fortunatamente il buon senso di cui è dotata la maggioranza dei notificatori, ma vi sono continuamente vittime della minoranza. Quest'anno è ancora più complicato: se un cliente (magari di quelli che solitamente non pagano) vorrà farmi un dispetto, salderà una parcella con bonifico proprio nel periodo in cui saremo chiusi per ferie, cosicché la parcella - fattura elettronica - non potrà essere emessa nei canonici 12 giorni. Solo per quest'anno e sino al 30 settembre 2019 alla fattura elettronica emessa oltre i 12 giorni ma entro il termine della liquidazione periodica iva non si applicano sanzioni per i contribuenti mensili (quindi se sono un "mensile iva" e mi accreditano il saldo di una parcella il 18 agosto ho tempo per emettere la fattura elettronica entro il 16 settembre 2019 senza sanzioni). Nel 2020 zero tolleranza. Ma se sono un "trimestrale iva" e mi accreditano il saldo di una parcella il 10 agosto (e sono in ferie) ho tempo a trasmettere la fattura elettronica entro e non oltre il 22 agosto (e sono ancora in ferie, magari durano proprio due settimane, 10 - 24 agosto) e trascorso il 22 agosto la trasmissione diviene sanzionabile. In sostanza: per evitare pasticci con le sanzioni al Codice della Strada puoi andare in ferie tre/quattro giorni per evitare pasticci con la fatturazione elettronica puoi andare in ferie 10/11 giorni nelle agenzie di viaggi, presto o tardi, arriveranno i pacchetti "fatturazione elettronica" da 10 giorni di soggiorno, quelli per il codice della strada saranno unicamente "week end lunghi".
