PER IMPEDIRE LA DECADENZA DELLE AGEVOLAZIONI "PRIMA CASA" L'EVENTO DEVE ESSERE "INEVITABILE ED IMPREVEDIBILE"


La Corte di Cassazione, Sez. 6 Civile, con l'ordinanza n. 14114 del 23 maggio 2019 ha ribadito il principio, già espresso nella sentenza n. 5015/2015, secondo cui, in tema di benefici fiscali cosiddetti "prima casa", la forza maggiore o il caso fortuito, idonei ad impedire la decadenza dell'acquirente che non abbia trasferito la propria residenza nel comune ove è ubicato l'immobile nel termine di 18 mesi dell'acquisto, devono consistere in un evento inevitabile ed imprevedibile, non ravvisabile né in caso di mancata ultimazione di un appartamento in costruzione né in caso di protrazione di lavori di straordinaria manutenzione di un immobile già edificato.
