AZIENDE SPECIALI E CONSORZI FRA ENTI TERRITORIALI - DEPOSITO DEL BILANCIO O DELLA SITUAZIONE PATRIMONIALE ENTRO IL 31 MAGGIO


Entro il 31 maggio di ciascun anno le aziende speciali di Enti Locali di cui all'articolo 114 del D.Lgs. n. 267/2000 hanno l'obbligo di deposito, nel Registro delle imprese, del proprio bilancio di esercizio nel formato tecnico elaborabile (XBRL). Con l'inserimento del comma 5-bis nell'art. 114 del D.Lgs. 18 agosto 2000, n. 267 (Testo unico delle leggi sull'ordinamento degli enti locali), disposto inizialmente dall'art. 25, comma 2, lett. a) del D.L. 24 gennaio 2012, n. 1, convertito, con modificazioni, dalla L. 24 marzo 2012, n. 27 e successivamente sostituito dall'art. 1, comma 560 della legge 27 dicembre 2013, n., 147 (legge di stabilità 2014) - a decorrere dall'anno 2013 - è stato infatti introdotto l'obbligo anche per le aziende speciali e le istituzioni degli Enti locali di depositate i propri bilanci al Registro delle imprese o nel Repertorio delle notizie economico-amministrative (REA) della Camera di Commercio di competenza, entro il 31 maggio di ogni anno. L'attuale comma 5-bis dell'articolo 114 del testo unico di cui al citato D.Lgs. n. 267/2000, stabilisce testualmente che «Le aziende speciali e le istituzioni si iscrivono e depositano i propri bilanci al registro delle imprese o nel repertorio delle notizie economico-amministrative della camera di commercio, industria, artigianato e agricoltura del proprio territorio entro il 31 maggio di ciascun anno». Questa scarna e imprecisa disposizione ha costretto il Ministero dello Sviluppo Economico ha fornire le opportune precisazioni e le prime indicazioni operative con la circolare n. 3669/C del 15 aprile 2014 e successivamente con la lettera-circolare del 22 ottobre 2014, Prot. 0185941. Le aziende speciali depositano nel Registro delle imprese il bilancio di esercizio, entro il 31 maggio 2017, mentre i consorzi di enti locali, entro lo stesso termine, depositano la situazione patrimoniale, in formato XBRL. Il bilancio e gli allegati (delibera dell'Ente locale di approvazione del bilancio; relazione di gestione e relazione dei revisori dei conti dell'azienda speciale) devono essere sottoscritti dal legale rappresentante dell'Azienda Speciale, in qualità di soggetto obbligato, o dal Segretario dell'Ente Locale, in qualità di soggetto legittimato.   • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
