SPLIT PAYMENT: L'UNIONE EUROPEA CONCEDE UNA NUOVA PROROGA FINO AL 30 GIUGNO 2020


A partire dal 1° luglio 2017 e fino al 30 giugno 2020, l'Italia, in deroga all'articolo 206 della direttiva 2006/112/CE, è autorizzata a disporre che l'IVA dovuta sulle cessioni di beni e sulle prestazioni di servizi alle Pubbliche Amministrazioni, alle società controllate da pubbliche amministrazioni e alle società quotate in borsa incluse nell'indice FTSE MIB, sia versata dall'acquirente/destinatario su un apposito conto bancario bloccato dell'amministrazione fiscale. Inoltre, in deroga all'articolo 226 della citata direttiva 2006/112/CE, l'Italia è autorizzata a imporre che nelle fatture emesse in relazione alle cessioni di beni e alle prestazioni di servizi effettuate a favore dei soggetti elencati sopra sia apposta una specifica annotazione secondo cui l'IVA deve essere versata su un apposito conto bancario bloccato dell'amministrazione fiscale. Entro 15 mesi dalla data di entrata in vigore sul territorio nazionale delle misure indicate sopra, l'Italia dovrà trasmettere alla Commissione una relazione sulla situazione generale dei rimborsi dell'IVA ai soggetti passivi interessati da tali misure e, in particolare, sulla durata media della procedura di rimborso, nonché sull'efficacia generale della presente misura per ridurre l'evasione dell'IVA nei settori interessati. Questo è quanto previsto dalla Decisione di esecuzione (UE) 2017/784 del Consiglio del 25 aprile 2017, pubblicata nella Gazzetta Ufficiale europea n. L 118/17 del 6 maggio 2017. La presente decisione si applicherà dal 1° luglio 2017 al 30 giugno 2020. Ricordiamo che con la precedente Decisione 14 luglio 2015, n. 2015/1401/UE (pubblicata sulla G.U.U.E. n. 217 del 18 agosto 2015) era stata già concessa una proroga sino al 31 dicembre 2017.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
