Senza esplicita adesione consultazione e-fatture più agevole


Il provvedimento firmato l’8 marzo 2024 dal direttore dell’Agenzia Entrate ha reso più semplice per i contribuenti consultare e acquisire le proprie fatture elettroniche tramite la funzionalità disponibile nell’area riservata del sito dell’Agenzia. Operatori economici, intermediari delegati e consumatori finali, infatti, a partire dal 20 marzo, non dovranno più aderire espressamente al servizio. L’aggiornamento della procedura deriva dall’allineamento con l’evoluzione normativa. La necessità dell’adesione espressa era prevista, infatti, dall’articolo 1, comma 3, del Dlgs n. 127/2015, secondo cui le e-fatture dovevano essere messe a disposizione dei consumatori finali su richiesta di quest’ultimi. Ma l’articolo 4-quinquies, comma 4, del Dl n. 145/2023, ha rivisto la norma ed eliminato la necessità di una espressa richiesta di consultazione da parte del consumatore finale. Tolto il vincolo dell’adesione specifica per i contribuenti, e fermo restando che l’Agenzia Entrate può memorizzare i file delle fatture elettroniche fino al 31 dicembre dell’ottavo anno successivo a quello di presentazione della dichiarazione di riferimento oppure fino alla definizione di eventuali giudizi, (articolo 1, comma 5-bis, Dlgs n. 127/2015, introdotto dall’articolo 14 del decreto legge n. 124/2019, convertito con legge n. 157/2019), il provvedimento dell’8 marzo 2024 estende a tutti i contribuenti, operatori economici, persone fisiche o soggetti diversi da persone fisiche non titolari di partita Iva, la possibilità di avvalersi del servizio di consultazione e acquisizione delle fatture elettroniche e dei loro duplicati informatici più agilmente, senza la necessità di sottoscrivere un accordo di servizio. I documenti elettronici rimarranno disponibili in consultazione fino al 31 dicembre del secondo anno successivo a quello di ricezione dei documenti fiscali da parte del Sistema di interscambio. Grazie a questa semplificazione, quindi, sarà possibile consultare le proprie fatture elettroniche che rientrano in questo arco temporale e non solo quelle registrate dall’Agenzia successivamente alla data di adesione. Un’ulteriore novità introdotta dal provvedimento è l’estensione agli enti non commerciali del servizio, già attivo per i titolari di partita Iva, di registrazione dell’indirizzo telematico, che consente di indicare l’indirizzo presso il quale intendono ricevere le proprie fatture indipendentemente dalle opzioni di compilazione del campo “CodiceDestinatario”.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
