RINEGOZIAZIONE CONTRATTO DI MUTUO PER ACQUISTO ABITAZIONE PRINCIPALE


In una recente risposta pubblicata sulla rivista telematica FiscoOggi l'Agenzia delle Entrate chiarisce che, nell'ipotesi in cui venga rinegoziato il mutuo acceso per acquistare l’abitazione principale, al fine di modificare alcune condizioni previste nel contratto in essere, si conserva il diritto alla detrazione degli interessi passivi, rimanendo invariati sia le parti originarie (banca mutuante e persona mutuataria) sia l’immobile concesso in garanzia. La detrazione sarà tuttavia limitata alla quota residua del capitale ancora da rimborsare alla data di rinegoziazione del contratto, alla quale potrebbero aggiungersi alcuni oneri correlati (eventuali rate scadute e non saldate, il rateo di interessi relativo al semestre in corso aggiornato al cambio del giorno della conversione, gli oneri derivanti dall'estinzione anticipata della provvista in valuta estera).   • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
