Rimborso Iva assolta in altri Paesi Ue: istanze di rimborso al 30 settembre 2019


La Direttiva 2008/9/UE prevede la possibilità, per le imprese che sostengono costi nei paesi aderenti la Comunità Europea, di chiedere il rimborso dell'IVA pagata all'estero su acquisti di prodotti e servizi. È possibile recuperare l'IVA pagata anche in Svizzera, Norvegia, Israele e Principato di Monaco, grazie ad accordi di reciprocità. Indichiamo, a titolo esemplificativo, alcune tipologie di costi soggetti all'IVA nel Paese estero (e per i quali non è possibile ricorrere al consueto reverse charge): Servizi fieristici: biglietti ingresso, pass Prestazioni e servizi relativi a beni immobili Lavorazione su stampi o beni strumentali Interventi su beni in garanzia e sostituzioni Organizzazione eventi Spese di trasferta aziendali Dal 1° gennaio 2010 è in vigore una nuova disciplina e per richiedere il rimborso dell'IVA allo Stato comunitario in cui è stata versata (o ai diversi Stati), il contribuente italiano deve presentare domanda di rimborso solo all'Agenzia delle Entrate (Direttiva 2008/9/CE del 12 febbraio 2008, recepita con Dlg n. 18/2010). Le istanze di rimborso devono essere presentate esclusivamente attraverso i servizi telematici dell'Agenzia Entrate (Entratel o Fisconline). Il termine previsto per la presentazione è il 30 settembre dell'anno solare successivo a quello per il quale si chiede la somma. Le informazioni che devono essere indicate nella richiesta di rimborso possono variare a seconda del Paese a cui viene inviata l'istanza e sono riassunte in apposita tabella pubblicata sul sito internet dell'Agenzia Entrate. L'operazione di controllo e gestione delle domande, prima della trasmissione allo Stato competente per il rimborso, è effettuata dal Centro Operativo di Pescara. Le informazioni inerenti allo stato di lavorazione delle istanze, successivamente all'invio al competente Stato comunitario, dovranno però essere richieste all'amministrazione fiscale estera competente, i cui recapiti sono indicati nell'elenco delle amministrazioni fiscali estere. Le informazioni inerenti al rifiuto dell'istanza da parte dell'amministrazione fiscale estera, vanno preliminarmente chieste ad essa e solo successivamente al Centro Operativo di Pescara.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
