REGISTRO ELETTRONICO DEGLI INDIRIZZI (REI) - APPROVATE LE REGOLE DI TRASMISSIONE DELLE PEC DA PARTE DEGLI OPERATORI FINANZIARI


Con il Provvedimento del Direttore dell'Agenzia delle Entrate del 10 maggio 2017, Prot. 90677, in tema di Registro degli Indirizzi Elettronici (REI), l'Agenzia delle Entrate è intervenuta per modificare ed integrare le disposizioni dettate da tre precedenti provvedimenti del Direttore della stessa Agenzia, specificando le regole di trasmissione degli indirizzi PEC. Con le disposizioni contenute nel presente provvedimento viene stabilito che il REI, costituito con Provvedimento 188870 del 22 dicembre 2005 per accogliere gli indirizzi PEC dei soggetti obbligati alle risposte alle Indagini finanziarie, è articolato in sezioni distinte, destinate ad accogliere gli indirizzi PEC dei soggetti obbligati alla comunicazione. Il presente provvedimento, pertanto, costituisce nuovo ed unico riferimento normativo nella definizione delle regole di trasmissione degli indirizzi PEC al REI. Nello specifico interviene su quanto disposto dai seguenti tre provvedimenti: del 22 dicembre 2005; del 12 novembre 2007 e del 20 giugno 2012. In particolare, al punto 2 vengono definiti, quali destinatari dell'obbligo di comunicazione al REI, per le rispettive sezioni di appartenenza: a) gli operatori finanziari già tenuti agli adempimenti in materia di indagini finanziarie previsti dal provvedimento Prot. n. 188870 del 22 dicembre 2005 e successive modifiche ed integrazioni sono tenuti ad iscriversi nella sezione REI denominata "REI Indagini"; b) i destinatari delle richieste di cui all'articolo 2, comma 1, lettera a) e lettera b) del decreto-legge 28 giugno 1990, n. 167, convertito dalla legge 4 agosto 1990, n. 227, come sostituito dall'articolo 9, comma 1, lettera b), della legge 6 agosto 2013, n. 97, attuato con Provvedimento congiunto dell'Agenzia delle Entrate e della Guardia di Finanza Prot. n. 105953 dell'8 agosto 2014 sono tenuti ad iscriversi nella sezione REI denominata "REI Monitoraggio"; c) le "Istituzioni finanziarie italiane tenute alla comunicazione" individuate dall'articolo 1, comma 1, numero 7.1., del decreto del Ministro dell'economia e delle finanze del 6 agosto 2015 e dall'articolo 1, comma 1, lettera n), del decreto del Ministro dell'economia e delle finanze del 28 dicembre 2015 in materia di scambio automatico obbligatorio di informazioni nel settore fiscale, fatte salve le eccezioni previste dai medesimi decreti, sono tenute ad iscriversi nella sezione REI denominata "REI FATCA/CRS". Al punto 4 viene disposto che a partire dal 1° giugno 2017 la comunicazione al REI è effettuata esclusivamente attraverso il tracciato record e le specifiche tecniche allegate al presente provvedimento (Allegati n. 1 e 2). Contestualmente, non potrà più essere utilizzato il tracciato record allegato n. 5 al provvedimento del 12 novembre 2007. Al punto 5 viene stabilito i soggetti, di nuova costituzione o per i quali sopravvengano i requisiti soggettivi e oggettivi che determinano l'obbligo di iscrizione al REI, comunicano le informazioni al Registro entro 30 giorni dall'evento. Ogni modifica intervenuta in una delle informazioni previste va effettuata entro il termine di 30 giorni dal verificarsi dell'evento modificativo. La comunicazione di aggiornamento o variazione ha effetto dal trentesimo giorno successivo alla data della stessa. La comunicazione al REI di un indirizzo di posta elettronica certificata non idonea perché non valida o non attiva, equivale al mancato invio dell'indirizzo.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
