PRESCRIZIONE DICHIARAZIONI FISCALI A FINE ANNO


Gli avvisi di accertamento relativi alle imposte sui redditi/IRAP e all’IVA, devono essere notificati entro il 31 dicembre del quinto anno successivo a quello di presentazione della dichiarazione. Entro il 31 dicembre 2023 dovranno quindi essere notificati gli eventuali accertamenti riferiti al periodo d’imposta 2017, con dichiarazione presentata nel corso del 2018. Quest’anno, poiché il 31 dicembre cade di domenica, la scadenza slitta a martedì 2 gennaio 2024. Tuttavia, per le annualità ancora “aperte” all’entrata in vigore del DL 18/2020 che aveva disposto la sospensione causa COVID “dall’8 marzo al 31 maggio 2020″ dei “termini relativi alle attività di liquidazione, di controllo, di accertamento, di riscossione e di contenzioso, da parte degli uffici degli enti impositori”, l’Agenzia Entrate rivendica ulteriori 85 giorni di tempo e quindi la scadenza slitterebbe dal 31 dicembre 2023 al 26 marzo 2024. Il tema è controverso e la giurisprudenza fin qui intervenuta sul tema ha quasi sempre censurato la tesi dell’Agenzia. Ricordiamo che i termini sopra indicati si applicano in caso di dichiarazioni presentate. Nei casi  di omessa dichiarazione, sia per le imposte sui redditi sia per l’IVA, il termine decadenziale è prolungato di due anni e corrisponde quindi al 31 dicembre del settimo anno successivo a quello in cui la dichiarazione avrebbe dovuto essere presentata.  Poiché i nuovi termini sono derivati dalla L. 208/2015, in caso di omessa dichiarazione: il periodo d’imposta 2015 è decaduto il 31 dicembre 2021 operando ancora i termini ante L. 208/2015 il periodo d’imposta 2016 decadrà il 31 dicembre 2024 (salvo proroga al 26 marzo 2025), operando i nuovi termini post L. 208/2015.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
