PATENT BOX: IL "TRACK AND TRACING" NON IDONEO PER DETERMINARE L'AMMONTARE DEL REDDITO ESTERO


Con il Principio di diritto n. 15/2021 l'Agenzia Entrate si è espressa in tema di determinazione del credito di imposta estero (art. 165, comma 1 e comma 10 del TUIR) per i soggetti che beneficiano dell'agevolazione Patent box ed ha chiarito che il sistema di "tracciabilità delle spese e dei costi", il cosiddetto "track and tracing", predisposto ai fini della suddetta agevolazione, non è idoneo a superare le difficoltà nella determinazione e nel controllo dei costi effettivamente imputabili a singoli elementi reddituali, in quanto non garantisce un livello di accuratezza tale da permettere la rilevazione e l'imputazione dei costi effettivi né sui singoli redditi percepiti, né sui singoli soggetti da cui provengono i redditi.  Conseguentemente, i soggetti che beneficiano dell'agevolazione Patent box sui redditi prodotti all'estero, non possono derogare al principio di assunzione "al lordo" del reddito estero. L'adozione di tale criterio garantisce, infatti, una perfetta simmetria tra la misura del reddito tassato all'estero e l'ammontare del reddito sul quale viene riconosciuto il credito d'imposta.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
