PACE FISCALE: LE ISTRUZIONI DELLE ENTRATE PER LA REGOLARIZZAZIONE VIOLAZIONI FORMALI


L'articolo 9, commi da 1 a 8, del decreto-legge n. 119 del 2018 ha introdotto la definizione agevolata delle violazioni formali. In applicazione del comma 8 del citato articolo l'Agenzia delle Entrate, con il provvedimento dal 15 marzo 2019, ha illustrato le modalità operative e la tempistica per la sanatoria di tali irregolarità. In particolare il provvedimento prevede che possano essere regolarizzate le violazioni formali per cui sono competenti gli uffici dell'Agenzia delle Entrate ad irrogare le relative sanzioni amministrative, commesse fino al 24 ottobre 2018 dal contribuente, dal sostituto d'imposta, dall'intermediario e da altro soggetto tenuto ad adempimenti fiscalmente rilevanti, anche solo di comunicazione di dati, che non rilevano sulla determinazione della base imponibile e dell'imposta, ai fini dell'IVA, dell'IRAP, delle imposte sui redditi, delle relative addizionali e imposte sostitutive, delle ritenute alla fonte, dei crediti d'imposta e sul relativo pagamento dei tributi. La regolarizzazione si perfeziona mediante: la rimozione delle irregolarità od omissioni; il versamento di 200 euro per ciascuno dei periodi d'imposta cui si riferiscono le violazioni formali indicati nel modello F24. Qualora le violazioni formali non si riferiscono ad un periodo d'imposta, occorre fare riferimento all'anno solare in cui sono state commesse. Il versamento può essere effettuato: in due rate di pari importo, la prima entro il 31 maggio 2019 e la seconda entro il 2 marzo 2020; in unica soluzione, entro il 31 maggio 2019.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
