NUOVI CODICI ATECO 2025: COMUNICAZIONE DI VARIAZIONE DATI NON OBBLIGATORIA


Dal 1° gennaio è entrata in vigore la nuova classificazione delle attività economiche ATECO 2025, approntata dall'Istat, che sostituisce la precedente versione ATECO 2007 (aggiornamento 2022). L'operatività della nuova classificazione è attiva dal 1° aprile 2025, sia per i contribuenti che per le Pubbliche Amministrazioni che la utilizzano per fini istituzionali.L'Agenzia delle Entrate, al fine di recepire la nuova classificazione ATECO 2025, ha adeguato le funzioni di acquisizione dei dati anagrafici e dei modelli dichiarativi. Gli operatori interessati sono tenuti ad utilizzare i nuovi codici negli atti e nelle dichiarazioni da presentare alle Entrate.Per le dichiarazioni Iva 2025, ad esempio, i contribuenti potranno indicare, in alternativa, i precedenti codici ATECO 2007 (aggiornamento 2022) oppure i "nuovi" codici ATECO 2025, avendo cura di riportare il codice 1 nella casella “Situazioni particolari” presente nel frontespizio del modello. Nella Risoluzione n. 24/E dell'8 aprile, l'Agenzia Entrate fornisce indicazioni operative in merito a alle modalità per verificare il codice attività attualmente presente in Anagrafe Tributaria e per effettuare la comunicazione del nuovo codice attività. Per verificare i codici ATECO collegati alla propria posizione fiscale e registrati in Anagrafe Tributaria, i contribuenti possono accedere alla propria area riservata del sito internet dell?"Agenzia delle entrate e consultare la sezione “Cassetto fiscale – Consultazioni – Anagrafica”. L?"adozione della nuova classificazione ATECO 2025, chiariscono ancora le Entrate, non comporta l?"obbligo di presentare la dichiarazione di variazione dei dati ai sensi degli articoli 35 e 35-ter del decreto Iva e articolo 7 comma 8 Dpr n. 605/1973. Tuttavia, il contribuente potrà comunicare i codici delle attività esercitate coerentemente con la nuova classificazione ATECO 2025 in occasione della presentazione della prima dichiarazione di variazione dei dati effettuata ai sensi delle citate disposizioni generali.  In caso di iscrizione al Registro delle Imprese, la dichiarazione di variazione dei dati dovrà essere effettuata con la Comunicazione Unica (ComUnica) messa a disposizione da Unioncamere; in caso contrario, il contribuente dovrà utilizzare uno dei modelli pubblicati sul sito internet dell?"Agenzia delle entrate, quindi: AA5/6 e AA7/10 (per soggetti diversi dalle persone fisiche); AA9/12 (per imprese individuali, lavoratori autonomi, artisti e professionisti, eccetera); ANR/3 (per l?"identificazione diretta ai fini Iva dei soggetti non residenti).   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
