Le Linee Guida per la valutazione di immobili a garanzia


Sono disponibili le "Linee guida per la valutazione degli immobili a garanzia dei crediti inesigibili": un nuovo strumento per favorire la trasparenza e la correttezza delle valutazioni degli immobili oggetto di procedure esecutive giudiziali e stragiudiziali. Il documento nasce dal Protocollo d'intesa per la valutazione degli immobili a garanzia di crediti inesigibili sottoscritto dai principali operatori del mercato (ABI, Assilea-Associazione italiana leasing, Assoimmobiliare-Associazione dell'Industria Immobiliare, Assovib, Collegio Nazionale degli Agrotecnici e degli Agrotecnici Laureati, Collegio Nazionale dei Periti Agrari e dei Periti Agrari Laureati, Confedilizia, Consiglio Nazionale degli Architetti Pianificatori Paesaggisti Conservatori, Consiglio Nazionale degli Ingegneri, Consiglio dell'Ordine Nazionale Dottori Agronomi e Dottori Forestali, Consiglio Nazionale dei Periti Industriali e dei Periti Industriali Laureati, Consiglio Nazionale Geometri e Geometri Laureati, E-Valuations-Istituto di Estimo e Valutazioni, Fiaip-Federazione Italiana Agenti Immobiliari Professionali, Isivi-Istituto Italiano di Valutazione Immobiliare, Rics-Royal Institution of Chartered Surveyors, Tecnoborsa-Consorzio per lo Sviluppo del Mercato Immobiliare S.C.p.A, TEGoVA-The European Group of Valuers' Association, T6-Tavolo di Studio sulle Esecuzioni Italiane). E' stato predisposto sulla base degli standard di valutazione internazionali e nazionali, e in aderenza ai principi riportati nelle Linee guida del CSM sulle buone prassi nel settore delle esecuzioni immobiliari e destinato a giudici, periti e Consulenti Tecnici di Ufficio (Ctu); ha anche l'obiettivo di contribuire a facilitare l'attuazione della disciplina sugli inadempimenti nei crediti immobiliari introdotta dalla Direttiva Europea sui mutui ipotecari. Tra gli aspetti di maggiore rilevanza contenuti nel documento, si segnalano in particolare: l'attenzione alla figura del perito; la definizione di "Valore di mercato" dell'immobile in esecuzione; l'attività di analisi per l'individuazione dei potenziali rischi della transazione immobiliare; l'elaborazione di un certificato di valutazione per la piena accessibilità alle informazioni. Le Linee Guida mirano quindi a valorizzare la garanzia immobiliare con un impatto positivo in termini di efficienza nel recupero del credito erogato, favorendo la massimizzazione del valore del residuo patrimonio eventualmente destinato al debitore.
