LA CASSAZIONE RESPINGE LA QUESTIONE DI LEGITTIMITà SULLA DEDUCIBILITà PARZIALE DELL'IRAP


In tema di IRAP, la questione di legittimità costituzionale per ritenuta violazione degli articoli 3 e 53 della Costituzione, dell'art. 6, commi 1 e 2, del DL n. 185/2008, convertito, con modificazioni, dalla L. n. 2/2009, nella parte in cui prevede, ai fini delle imposte sui redditi, la deducibilità parziale (anziché integrale) dell'imposta regionale sulle attività produttive, è manifestamente infondata, risultando irrilevante quanto statuito dalla sentenza della Corte costituzionale n. 262/2020 in ordine alla deducibilità dell'IMU, trattandosi di tributi differenti, relativi a fattispecie non assimilabili, e tenuto conto che il legislatore può, con scelta insindacabile se non palesemente arbitraria o irrazionale, discrezionalmente porre limiti alla deducibilità dei costi.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
