L?"INTIMAZIONE POST CARTELLA NON VUOLE MOTIVAZIONI AD HOC


È sufficiente un suo richiamo poiché l'atto precedente contiene già gli elementi che consentono al contribuente di conoscere le ragioni della pretesa tributaria e di esercitare il diritto di difesa. L'avviso di intimazione ad adempiere l'obbligo risultante dal ruolo, da notificare al contribuente in base a quanto previsto dall'articolo 50, commi 2 e 3, del Dpr n. 602/1973, ha un contenuto vincolato, in quanto deve essere redatto in conformità al modello approvato con decreto del ministero dell'Economia, sicché è sufficiente che la motivazione faccia riferimento alla cartella di pagamento in precedenza notificata. La Corte di cassazione, con l’ordinanza n. 10692 dell’11 aprile 2024, ha ribadito il principio secondo cui l’intimazione di pagamento non necessita di particolare motivazione, essendo sufficiente il richiamo alla cartella di pagamento presupposta.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
