INVESTIMENTI TRANSIZIONE 4.0: COME UTILIZZARE IL CODICE SOSPESO '6936' PER I CREDITI NON INTERESSATI DAL BLOCCO


Con Risoluzione n. 19/E del 12 aprile 2024 l'Agenzia delle Entrate ha sospeso l'utilizzo in compensazione tramite modello F24 dei crediti per investimenti in beni strumentali nuovi, di cui al codice tributo 6936, riferiti agli anni 2023 e 2024. Considerato che tale codice tributo è utilizzato anche per la fruizione di crediti d’imposta di cui all'art. 1, commi 1056 e 1057 della L. n. 178/2020, che non sono interessati dal blocco, con una Risposta del 16 aprile l'Agenzia chiarisce come è possibile mantenere l’operatività del codice al fine di utilizzare in compensazione i crediti maturati ai sensi dei suddetti commi 1056 e 105, che si riferiscono agli investimenti in beni strumentali nuovi, effettuati rispettivamente: dal 16 novembre 2020 al 31 dicembre 2021 (ovvero entro il 31 dicembre 2022, a condizione che entro il 31 dicembre 2021 il relativo ordine risulti accettato dal venditore e sia avvenuto il pagamento di acconti in misura almeno pari al 20% del costo di acquisizione) dal 1° gennaio 2022 al 31 dicembre 2022 (ovvero entro il 30 novembre 2023, a condizione che entro il 31 dicembre 2022 il relativo ordine risulti accettato dal venditore e sia avvenuto il pagamento di acconti in misura almeno pari al 20% del costo di acquisizione). In entrambi i casi, spiegano le Entrate, se l’interconnessione del bene strumentale è avvenuta negli anni 2023 o 2024, è possibile utilizzare il relativo credito in compensazione tramite modello F24 indicando il codice tributo 6936 e, quale anno di riferimento, l’anno in cui è iniziato l’investimento, a prescindere dall’anno in cui questo si è concluso o dall’anno di interconnessione del bene strumentale. Ad esempio, per un credito maturato ai sensi del comma 1057 per un investimento iniziato nel 2022 e terminato nel 2023, nel modello F24 dovrà essere indicato l’anno di riferimento “2022”.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
