INSEGNANTE E LEZIONI PRIVATE: OBBLIGO DI PARTITA IVA


Risposta all’interpello n. 63/2024 Il caso: l’insegnante ante titolarietà di cattedra presso una scuola statale, aveva aperto una partita iva per l’attività di lezioni private di lingua straniera. Ora, ottenuta la cattedra con impiego part time, intende impartire lezioni private nell’ottica di 5/6 a settimana, previa autorizzazione del dirigente scolastico. Ante assunzione di cattedra per le lezioni private venivano emesse fatture in regime forfetario. Intenderebbe ora chiudere la partita iva, atteso che ai sensi della Legge 145/2018 (articolo 1 commi da 13 a 16) per le lezioni private è prevista l’applicazione di un’imposta sostitutiva (di irpef e addizionali) del 15% per i docenti titolari di cattedra, con obbligo di comunicazione all’amministrazione di appartenenza per la verifica di situazioni di incompatibilità (salvo opzione da parte dell’insegnante per l’applicazione dell’irpef e addizionali nei modi ordinari).  L’Agenzia delle Entrate precisa che il reddito assoggettato ad imposta sostitutiva non concorre alla formazione del reddito complessivo, concorre invece a determinare la situazione economica ai fini ISEE, ferma restando la possibilità di optare per l’applicazione dell’Irpef e addizionali nei modi ordinari. Ai fini IVA l’Agenzia rileva che qualora l’attività venga svolta in modo abituale  e non occasionale, i corrispettivi vanno assoggettati ad iva. Considerato che l’interessato ha indicato che intende svolgere 5/6 lezioni a settimana, secondo l’agenzia è confermata lo svolgimento della stessa con carattere di abitualità, mantenendo la partita iva di cui è già in possesso ed applicando il 15% di imposta sostitutiva (da forfetario), con obbligo di fatturazione oppure in alternativa applicare l’imposta sostitutiva del 15% di cui alla legge 145/2018 con obbligo di fatturazione in regime di esenzione iva ai sensi articolo 10 n. 20 del DPR 633/72 (salvo dispensa per operazioni esenti ai sensi ex art. 36 bis del DPR 633/72).
