Incentivo per datori di lavoro all'occupazione giovanile e sua procedura di accesso, disciplinato nel nuovo Decreto Lavoro


L’articolo 27 del D.L. n. 48/2023 ( c.d. “Decreto Lavoro”) al fine di sostenere l’occupazione giovanile, introduce un incentivo nuovo per i datori di lavoro privati. Tale incentivo consiste in un contributo economico nella misura del 60% della retribuzione lorda mensile imponibile ai fini previdenziali, per l’assunzione di giovani nel rispetto di specifici requisiti.REQUISITII seguenti requisiti devono sussistere congiuntamente: nuove assunzioni a tempo indeterminato, di apprendistato professionalizzante o di mestiere, di somministrazione, tali assunzioni devono essere effettuate a decorrere dal 1° giugno e fino al 31 dicembre 2023, devono riguardare giovani che alla data di assunzione: non devono aver compiuto il trentesimo anno d’età, non lavorino o che non siano inseriti in corsi di studio o di formazione (tale categoria viene inserita nella categoria “NEET” ossia “Not in Education, Employment or Training”), siano registrati al programma operativo nazionale “Iniziativa Occupazione Giovani” (Garanzia giovani). DURATA E MODALITA’ DI EROGAZIONE DEL BENEFICIO LA DATORE DI LAVOROTale incentivo ha una durata di 12 mesi e viene erogato al datore di lavoro attraverso il conguaglio nelle denunce contributive mensili.POSSIBILE CUMULABILITÀ CON ALTRI INCENTIVI L’incentivo in trattazione è cumulabile: con l'esonero contributivo per l'assunzione di giovani; con altri esoneri o riduzioni delle aliquote di finanziamento previsti dalla normativa vigente, limitatamente al periodo di applicazione degli stessi, e comunque nel rispetto dei limiti massimi previsti dalla normativa europea in materia di aiuti di Stato. Si evidenzia che in caso di cumulo con un’altra misura, l’incentivo sarà corrispostonella misura del 20% della retribuzione lorda imponibile ai fini previdenziali.MODALITA’ DI PRESENTAZIONE DELLA DOMANDA DI ACCESSO A TALE INCENTIVO DA PARTE DEL DATORE DI LAVORO E SUA FRUIZIONEIl datore di lavoro per poter accedere a questo incentivo: deve trasmettere all’INPS una domanda preventiva da effettuarsi attraversospecifica procedura telematica. In risposta alla domanda presentata dal datore di lavoro, l’Inps: rispetterà nella sua valutazione l’ordine cronologico di presentazione delle domande; entro 5 giorni, comunicherà telematicamente la sussistenza della disponibilità di risorse per l’accesso all’incentivo a valere come riserva dell’incentivo richiesto. Il datore di lavoro dovrà entro i 7 giorni successivi: provvedere alla stipula del contratto di lavoro che dà diritto all’accesso all’incentivo; comunicare telematicamente all’Inps l’avvenuta stipula del contratto di lavoro. Nel caso in cui il datore di lavoro non rispetti i suddetti termini di 7 giorni: decade la riserva delle somme operata in suo favore, tali somme tornano a disposizione di ulteriori potenziali richiedenti.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
