IMU AL PROPRIETARIO DELL'IMMOBILE IN CASO DI MANCATO PAGAMENTO DELL'INQUILINO


L’Imu è dovuta dal soggetto che sia possessore di diritto dell’immobile, per cui è sempre a carico del soggetto che risulti titolare dell’immobile al catasto o, meglio, presso la Conservatoria dei registri immobiliari. Non sono quindi tenuti al versamento il comodatario, l'affittuario, l'utilizzatore o l'occupante dell'immobile.  Di conseguenza, escludendo che gli accordi che pongono il carico tributario su un soggetto diverso dal proprietario, o titolare di altro diritto reale, non possono essere contra legem, qualora non sia possibile ottenere il pagamento da parte del diverso soggetto individuato contrattualmente, le imposte locali sugli immobili devono essere pagate dal proprietario.  Così si è espressa la Corte di Giustizia Tributaria di secondo grado della Toscana (Sentenza n. 307 del 6 marzo 2024).Nel caso di specie, relativo a un contratto di leasing, la CGT della Toscana ha chiarito che in seguito alla risoluzione del contratto, è il locatore a dover versare l’imposta, anche se non ha ancora acquisito la materiale disponibilità del bene per mancata riconsegna da parte dell'utilizzatore.
