IL PRATICANTE ABILITATO PUò SOSTITUIRE L'AVVOCATO IN UDIENZA?


Il Consiglio Nazionale Forense, con il parere n. 79 del 12 dicembre 2018 ed in risposta ad un quesito posto dal Consiglio dell'Ordine degli Avvocati di Varese, ha precisato che, relativamente al perimetro operativo dell'abilitazione sostitutiva, la legge n. 247/2012 prevede tre diverse scadenze temporali riguardanti il tirocinio, i suoi tempi ed i relativi effetti, ossia: 6 mesi dall'iscrizione nel Registro dei praticanti per la richiesta di abilitazione; 18 mesi dalla suddetta iscrizione per il compimento del periodo di tirocinio, con conseguente diritto al rilascio del relativo certificato; 5 anni di durata massima dell'abilitazione sostitutiva, che permette al praticante l'esercizio dell'attività professionale per 5 anni a partire dall'iscrizione nel Registro Abilitati (e nei limiti dettati dall'art. 41, comma 12, L n.247/2012), a prescindere dal fatto che al praticante sia stato rilasciato il certificato di compiuta pratica.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
