ICI: ESENZIONE PER LE PERTINENZE SOLO SE COMUNICATE AL COMUNE


La Corte di Cassazione, con Ordinanza n. 3595 del 12 febbraio 2025, ha chiarito che le aree pertinenziali non sono soggette a tassazione autonoma ai fini ICI quando il Comune ne è a conoscenza a seguito di un'apposita comunicazione da parte del contribuente. La sentenza ha riguardato il caso di una società immobiliare che ha contestato un avviso di accertamento per omessa denuncia ICI su aree classificate come edificabili dal Comune. Affinché un'area sia considerata pertinenziale, ha chiarito la Cassazione, non è sufficiente che soddisfi i requisiti previsti dall?"art. 817 del Codice Civile (destinazione oggettiva al servizio di un altro bene e impossibilità di diversa destinazione senza radicale trasformazione), ma è necessario che l?"Amministrazione comunale sia effettivamente consapevole di questa destinazione. Se il Comune non dispone di altre informazioni che attestino il vincolo di pertinenzialità, la prova deve emergere da una comunicazione esplicita del contribuente.
