I NUOVI LIMITI PER LA QUALIFICA DI "CATTIVO PAGATORE": INCUBO DEFAULT PER MOLTE PMI


Dal prossimo 1° gennaio 2021 entrerà in vigore la nuova classificazione europea dello stato di inadempienza per le imprese nei confronti degli istituti di credito (regolamento Ue n. 171 del 19/10/2017). La nuova classificazione si caratterizza per le soglie molto più basse che in passato: per le PMI sarà sufficiente avere un arretrato di oltre 90 giorni nei confronti di una banca, superiore a 100 euro e all’1% dell’esposizione totale verso la banca stessa, per vedersi inserire nella lista dei “cattivi pagatori”. L’impresa si considera in default quando si verifica almeno una delle seguenti condizioni: 1) La banca giudica improbabile il recupero del credito senza l’escussione delle garanzie 2) Il debitore è in arretrato da oltre 90 giorni su un’esposizione rilevante Dal 1° gennaio 2021 la soglia di rilevanza sarà superata quando saranno soddisfatte congiuntamente le seguenti condizioni: Esposizioni verso imprese: Componente assoluta = 500 euro Componente relativa = 1% dell’esposizione complessiva Esposizioni verso PMI con esposizioni inferiori a 1 milione di euro: Componente assoluta = 100 euro Componente relativa = 1% dell’esposizione complessiva Non saranno ammesse compensazioni tra le diverse esposizioni del debitore nei confronti della banca e il default su una singola esposizione comporterà l’automatico default di tutte le esposizioni in essere dell’impresa nei confronti della stessa banca. Nel caso in cui l’impresa possa essere classificata come PMI e abbia una esposizione complessiva verso la banca inferiore a 1 milione di euro, l’estensione può non essere automatica. Le Associazioni di categoria hanno già unanimemente manifestato tutta la loro preoccupazione, invitando il legislatore a valutare un rinvio che tenga conto dell’attuale stato emergenziale. Anche il presidente dell’Abi, Antonio Patuelli, nel corso di un forum dell’ANSA ha dichiarato sul tema che “Ci sono delle regole europee che bisogna correggere” sulle banche “per evitare che arrivi una nuova restrizione del credito per applicazione di regole pensate prima della pandemia, quando invece c’è tutto un incoraggiamento da parte della Bce, della Banca d’Italia e delle istituzioni della Repubblica per sostenere le imprese e le famiglie con prestiti anche garantiti“.
