BONUS EDILIZI: COME RIMEDIARE IN CASO DI RITARDI O ERRORI NELLA COMUNICAZIONE


Con la Circolare n. 33 del 6 ottobre l'Agenzia delle Entrate ha illustrato le novità in merito alla cessione o allo sconto in fattura dei bonus edilizi dopo la conversione in legge dei decreti Aiuti (Dl n. 50/2022) e Aiuti-bis (Dl n.115/2022), oltre a fornire istruzioni su come rimediare in caso di eventuali ritardi o errori nella comunicazione per l'esercizio delle opzioni di sconto in fattura e cessione del credito. In particolare, vengono fornite indicazioni per rimediare: in caso di ritardi nella comunicazione:  fissata una finestra temporale più ampia per coloro che non hanno inviato nei tempi la comunicazione per l’esercizio dell’opzione per lo sconto in fattura o la cessione del credito (quindi entro il 29 aprile 2022 per le spese sostenute nel 2021 e per le rate residue non fruite delle detrazioni riferite alle spese sostenute nel 2020). In presenza di determinate condizioni, è infatti possibile avvalersi della "remissione in bonis", istituto che consente di inviare la comunicazione fino al 30 novembre 2022 (termine di presentazione della dichiarazione dei redditi), versando un importo pari alla misura minima della sanzione stabilita;   in caso di errori commessi nella compilazione della comunicazione: se l’errore nella comunicazione è formale, ad esempio sono stati riportati in modo sbagliato i dati catastali o lo stato di avanzamento lavori, è sufficiente inviare una segnalazione tramite PEC. Se invece l’errore è sostanziale, cioè se incide su elementi essenziali del credito ceduto, è possibile trasmettere una comunicazione sostitutiva entro il quinto giorno del mese successivo a quello di invio. Decorso tale termine, se il cessionario ha accettato il credito, le parti potranno richiedere l’annullamento dell’accettazione dei crediti derivanti da comunicazioni di prime cessioni o sconti non corrette, inviando un apposito modello - allegato alla circolare - a una casella PEC dedicata.   Fonte: https://agenziaentrate.gov.it
