VALUTAZIONE D'IMPATTO AMBIENTALE (VIA) - LE NUOVE LINEE GUIDA DELLA COMMISSIONE EUROPEA


In seguito alle modifiche della disciplina sulla valutazione di impatto ambientale intervenute con la direttiva 2014/52/UE la Commissione europea ha pubblicato a metà novembre 2017 nuove linee guida sulla VIA. I documenti della Commissione sono tre e riguardano: le procedure di Screening (verifica di assoggettabilità a VIA), di Scoping (definizione dei contenuti dello studio di impatto ambientale) e la predisposizione dello Studio di Impatto Ambientale. La prima Linea guida è dedicata allo "Screening" o verifica di assoggettabilità a VIA e costituisce una guida che aiuta tutti i soggetti interessati (imprese, consulenti, Pubblica Amministrazione) ad effettuare correttamente questa fase importante del procedimento che porterà a valutare se un progetto vada o meno sottoposto a VIA (art. 19, D.Lgs. n.152/2006). La seconda delle Linee guida invece è dedicata allo "Scoping" la fase eventuale di confronto tra proponente e Autorità competente che consente al primo di sapere quante informazioni e documenti dovrà fornire nel procedimento di VIA per consentire all'Autorità competente di fare una corretta valutazione dell'impatto ambientale del progetto (art. 21, D.Lgs. n. 152/2006). La terza Linea guida fornisce utili informazioni su come redigere correttamente lo studio di impatto ambientale, il documento principale nel procedimento di VIA (art. 22, D.Lgs. n. 152/2006). Le nuove linee guida aggiornano e integrano le linee guida già pubblicate nel 2001 per garantire la necessaria coerenza con le nuove disposizioni della direttiva 2014/52/UE, che ha introdotto significative modifiche alla disciplina della VIA, sia procedurali che tecniche. I documenti sono stati predisposti anche con la collaborazione degli Stati membri nell'ambito del Gruppo di Esperti Nazionali VIA-VAS della Commissione europea, nel quale il Ministero dell'Ambiente è rappresentato con il focal point nazionale designato dalla Direzione per le Valutazioni e le Autorizzazioni Ambientali. Ricordiamo che alla direttiva 2014/52/UE è stata data attuazione con il D.Lgs. 16 giugno 2017, n. 104, entrato in vigore il 21 luglio 2017.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
