CESSIONE DEI CREDITI: LA PROCEDURA DI SOSPENSIONE PREVISTA DAL DECRETO ANTIFRODI


Gli articoli 121 e 122 del Decreto Rilancio hanno previsto la possibilità di optare, al posto dell’utilizzo diretto della detrazione spettante o del credito d’imposta: per la cessione del credito d’imposta ad altri soggetti, compresi gli istituti di credito e altri intermediari finanziari; per un contributo sotto forma di sconto sul corrispettivo dovuto.  Con lo scopo di contrastare le frodi in materia di cessione dei crediti il DL n. 157/2021 (cd. Decreto "Antifrodi") ha introdotto il nuovo articolo 122-bis del DL n. 34/2020, che prevede che l'Agenzia delle Entrate possa sospendere, fino a 30 giorni, le comunicazioni delle cessioni dei crediti, anche successive alla prima, e delle opzioni inviate ai sensi dei richiamati articoli, connotate da profili di rischio. Con il Provvedimento del 1 dicembre 2021 vengono definiti i criteri e le modalità per la sospensione delle suddette comunicazioni inviate all’Agenzia delle Entrate. In particolare, sono individuati i profili di rischio da considerare ai fini del controllo preventivo delle comunicazioni e sono disciplinate le modalità di sospensione e di annullamento delle comunicazioni stesse. Cosa succede a seguito della sospensione Qualora, all'esito del controllo, i rischi risultino confermati, la comunicazione è annullata e l'esito del controllo è comunicato al soggetto che l’ha trasmessa.  Invece, nel caso in cui detti rischi non risultino confermati, oppure sia trascorso il periodo di sospensione di 30 giorni, la comunicazione produce gli effetti previsti.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
