ANCHE LA TEMPORANEA INDISPONIBILITà DELLA DOCUMENTAZIONE INTEGRA IL REATO DI OCCULTAMENTO DELLE SCRITTURE CONTABILI


Con la Sentenza n. 10106 del 16 marzo 2021 la Corte di Cassazione, Sez. 3 Penale, si è espressa in tema di reati tributari chiarendo che la responsabilità penale per il reato di l'occultamento delle scritture contabili, si realizza anche quando la documentazione viene consegnata successivamente all'Agenzia delle Entrate.  "In tema di reati tributari il delitto di occultamento o distruzione di documenti contabili di cui all'art. 10 del d. Igs n. 74 del 2000 costituisce un reato di pericolo concreto, che è integrato, nel caso della distruzione, dall'eliminazione della documentazione o dalla sua alterazione con cancellature o abrasioni, e, nel caso dell'occultamento, dalla temporanea o definitiva indisponibilità dei documenti, realizzata mediante il loro materiale nascondimento, configurandosi, in tale ultima ipotesi, un reato permanente". Per la consumazione del reato, dunque, basta anche la temporanea indisponibilità della documentazione. La successiva produzione della documentazione all'Agenzia delle entrate, infatti, fa solo cessare la permanenza del reato. Fonte: https://www.cortedicassazione.it/
