CITTADINANZA DIGITALE: IL CDM APPROVA UN DECRETO CHE PREVEDE UN RAFFORZAMENTO DELLE DISPOSIZIONI ATTUALI


Il Consiglio dei Ministri, nella seduta n. 43 dell'8 settembre 2017, ha approvato, in esame preliminare, tre decreti legislativi che introducono disposizioni integrative e correttive ai decreti legislativi di attuazione della riforma della pubblica amministrazione. Uno di questi introduce alcune modifiche al Codice dell'amministrazione digitale, che prevedono di dotare cittadini, imprese e amministrazioni di strumenti e servizi idonei a rendere effettivi i diritti di cittadinanza digitale. Nello specifico il decreto intende: proseguire nell'opera di razionalizzazione delle disposizioni contenute nel Codice dell'amministrazione digitale e di deregolamentazione già avviata con il precedente intervento; rafforzare la natura di "carta di cittadinanza digitale" della prima parte del Codice, concentrando in essa le disposizioni che attribuiscono a cittadini e imprese il diritto a una identità e a un domicilio digitale, quello alla fruizione di servizi pubblici online, quello a partecipare effettivamente al procedimento amministrativo per via elettronica e quello a effettuare pagamenti online; promuovere integrazione e interoperabilità tra i servizi pubblici erogati dalle diverse amministrazioni; garantire maggiore certezza giuridica in materia di formazione, gestione e conservazione dei documenti digitali; rafforzare l'applicabilità dei diritti di cittadinanza digitale e accrescere il livello di qualità dei servizi pubblici e fiduciari in digitale; promuovere un processo di valorizzazione del patrimonio informativo pubblico e garantire un utilizzo più efficace dei dati pubblici attraverso moderne soluzioni di data analysis. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
