DEFINIZIONE AGEVOLATA CONTROVERSIE PENDENTI: ATTIVO IL SERVIZIO PER LA COMPILAZIONE E L'INVIO DELLE ISTANZE


Con un Comunicato Stampa del 6 marzo scorso l'Agenzia delle Entrate ha informato i contribuenti che, sul proprio sito internet, è disponibile il servizio per compilazione e la trasmissione online, entro il 31 maggio 2019, delle istanze per chiudere le liti fiscali pendenti. Entro questa data, i contribuenti che intendano usufruire dell'agevolazione devono presentare telematicamente una domanda di definizione per ciascuna controversia tributaria accedendo alla propria area riservata dei canali Entratel o Fisconline e utilizzando la funzione "Domanda definizione agevolata controversie tributarie pendenti - art. 6 e art. 7, comma 2 lett. b) e comma 3, Dl n. 119/2018" per la compilazione e la trasmissione, all'interno della sezione "Servizi per > Richiedere". In alternativa, la domanda può essere presentata anche tramite intermediario abilitato o recandosi presso un qualsiasi Ufficio territoriale dell'Agenzia. Le Entrate ricordano che la definizione agevolata è ammessa esclusivamente per le controversie tributarie in cui è parte l'Agenzia delle Entrate, aventi ad oggetto atti impositivi, pendenti in ogni stato e grado di giudizio - compreso quello in Cassazione e anche a seguito di rinvio - nelle quali il ricorso sia stato notificato entro il 24 ottobre 2018, e per le quali alla data di presentazione della domanda il processo non si è concluso con pronuncia definitiva. Sono invece escluse le liti aventi ad oggetto atti di mera liquidazione e riscossione, quelle di valore indeterminabile, oltre a quelle relative al rifiuto alla restituzione di tributi. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
