DETENUTI CHE SVOLGONO ATTIVITà LAVORATIVA IN ISTITUTI PENITENZIARI: CHIARIMENTI SULLA NASPI


Con il Messaggio n. 909 del 5 marzo 2019 l'Inps fornisce chiarimenti in merito all'erogabilità della prestazione di disoccupazione nei confronti di detenuti impegnati in attività di lavoro presso l'Istituto penitenziario dove si trovino ristretti. L'Istituto precisa che, a tali soggetti che svolgano attività lavorativa retribuita all'interno della struttura ed alle dipendenze della stessa, non può essere riconosciuta la prestazione di disoccupazione in occasione dei periodi di inattività in cui essi vengano a trovarsi. È fatto salvo, invece, il diritto degli stessi alla indennità di disoccupazione da licenziamento nel caso in cui il rapporto di lavoro si sia svolto con datori di lavoro diversi dall'Amministrazione penitenziaria. Sul piano contributivo, tuttavia, gli Istituti penitenziari sono comunque tenuti al versamento della contribuzione contro la disoccupazione per i detenuti che svolgono attività alle loro dipendenze. Sotto il profilo assicurativo, detta contribuzione sarà utile - nel caso di cessazione involontaria da un rapporto di lavoro con datori di lavoro diversi dall'Istituto penitenziario - ai fini della prestazione di disoccupazione NASpI, qualora rientrante nei quattro anni precedenti l'inizio del periodo di disoccupazione. L'Inps ricorda infine che i detenuti che già godevano del diritto all'indennità di disoccupazione prima che iniziasse lo stato di detenzione continuano ad averne diritto anche durante il periodo di detenzione, salvi i casi di revoca giudiziale della prestazione.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
