MISURE CORRETTIVE AL CODICE DEGLI APPALTI: DETTATE NORME IN MATERIA DI SEMPLIFICAZIONE/ACCELERAZIONE PROCEDURE NEGLI APPALTI PUBBLICI SOTTO SOGLIA COMUNITARIA


L'articolo 5, recante norme in materia di semplificazione e accelerazione delle procedure negli appalti pubblici sotto soglia comunitaria, interviene sull'articolo 80 del codice dei contratti pubblici in materia di motivi di esclusione. Più nel dettaglio il comma 1 dell'articolo 5 modifica il comma 5 dell'articolo 80 del decreto legislativo n. 50 del 2016 (Codice dei contratti pubblici), sostituendo la lettera c) con tre nuove lettere. Come precisa la relazione illustrativa, l'articolo 5 interviene sul codice dei contratti pubblici al fine di "allineare il testo dell'articolo 80, comma 5, lettera c) del codice alla direttiva 2014/24/UE, articolo 57, par. 4, che considera in maniera autonoma le quattro fattispecie di esclusione indicate erroneamente, a titolo esemplificativo nell'attuale lettera c)...". La lettera c) come riformulata prevede che possa essere escluso dalla partecipazione alla procedura d'appalto un operatore economico qualora la stazione appaltante dimostri, con mezzi adeguati, che esso si sia reso colpevole di gravi illeciti professionali, tali da rendere dubbia la sua integrità o affidabilità. Rispetto alla formulazione vigente quindi è soppresso il più volte citato elenco delle cause di esclusione. Ai sensi delle nuove lettere c-bis) e c-ter) le stazioni appaltanti escludono dalla partecipazione alla procedura d'appalto un operatore economico in una delle seguenti situazioni, anche riferita a un suo subappaltatore, qualora l'operatore economico abbia: - tentato di influenzare indebitamente il processo decisionale della stazione appaltante o di ottenere informazioni riservate a fini di proprio vantaggio oppure abbia fornito, anche per negligenza, informazioni false o fuorvianti suscettibili di influenzare le decisioni sull'esclusione, la selezione o l'aggiudicazione, ovvero abbia omesso le informazioni dovute ai fini del corretto svolgimento della procedura di selezione (lettera c-bis); - dimostrato significative o persistenti carenze nell'esecuzione di un precedente contratto di appalto o di concessione che ne hanno causato la risoluzione per inadempimento ovvero la condanna al risarcimento del danno o altre sanzioni comparabili. Su tali circostanze la stazione appaltante deve motivare anche con riferimento al tempo trascorso dalla violazione e alla gravità della stessa (lettera c-ter).   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
